2. Service Level & Infrastructure

We provide the Service on a "Best Effort" basis. You acknowledge that our physical infrastructure is located in a private residential office.

• We target 99.9% uptime but strictly do not offer financial guarantees or credits for downtime.
• You acknowledge that the Service is subject to residential-grade utility interruptions (e.g., ISP fiber maintenance or local power outages) which are outside our reasonable control.
• We reserve the right to perform emergency maintenance to secure the infrastructure.

3. Backups & Data Integrity

For Managed Hosting clients, we perform daily off-site backups to a secondary location. For Storage (S3) clients, we utilise ZFS redundancy (RAID-Z) to protect against drive failure.

However, Layer6 accepts no liability for data loss, corruption, or business interruption caused by hardware failure, fire, theft, or force majeure events. You agree that you are responsible for maintaining your own independent local copies of critical data.

4. Payments & Cancellation

Services are billed monthly in advance via Stripe.

• Cancellation: You may cancel at any time. Services will continue until the end of the current billing period. We do not offer pro-rated refunds.
• Non-Payment: We reserve the right to suspend services if payment is more than 7 days overdue.

5. Acceptable Use Policy (AUP)

You may not use Layer6 infrastructure for:

• Hosting illegal content (under UK Law).
• Sending unsolicited email (Spam).
• Cryptocurrency mining or excessive CPU burning scripts.
• Network scanning, phishing, or malware distribution.

Violation of this policy will result in immediate termination without refund.

6. Limitation of Liability

To the maximum extent permitted by law, the liability of Layer6 and Donal Lang for any claim arising out of these terms shall be limited to the amount you paid for the services in the month preceding the claim.

You explicitly acknowledge the residential nature of the hosting infrastructure and waive any claim for damages resulting from residential utility failures (Power/Internet).

We are not liable for indirect or consequential losses (e.g., lost profits, loss of reputation).

7. Jurisdiction

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
